Overview

This privacy policy applies to the privacy practices of Wiland, Inc. It describes our practices relative to Wiland.com and the services, features, and functions available through it (collectively, the Site) and the information you submit through the Site. By using the Site, you consent to these practices. Your use of the Site is also governed by our Terms of Use. The Wiland Client Gateway contains additional terms and conditions applicable to Wiland clients and their use of products, services, and resources available through the gateway.

This privacy policy also contains descriptions of how we collect and use information of individuals outside the Site relative to our relationships with our clients, partners or vendors or potential clients, partners or vendors, how we collect and use information related to our employment or potential employment of individuals (including via the Site), how we use consumer data in our products and services, and information on where you can find some related legally required disclosures.

This overview section summarizes the privacy policy, and you may refer to the sections below for additional detail on our information collection, use and sharing practices.

Information We Collect Through the Site

We collect several types of information from you when you use the Site. We may collect information that identifies you (we refer to this in this privacy policy as “personal information”) such as when you fill out a form or request information. We also collect information about how you interact with the Site, and we collect technical information about the hardware and software you use to access the Site. We do not knowingly collect information we consider to be sensitive through the Site and you should not submit it through the Site.

Personal Information We Collect Outside the Site

We collect personal information outside the Site from various sources, including third party data providers and our vendors, partners and service providers. This information typically relates to our clients, partners or vendors or potential clients, partners or vendors and relates to our relationship or potential relationship with these parties.

How We Use Information

We are a business-to-business company, and we use the information we collect through the Site and outside the Site to support your business relationship with Wiland and to operate, develop and improve our business and the Site. We may also collect information you provide us through the Site to identify you on a non-personally identifiable basis across other websites for business-to-business advertising purposes. We may share the information collected through the Site or outside the Site with third parties that assist us in operating and improving our business and the Site, and with select partners to pursue our business.

If you are a consumer whose data may be used for our marketing products and services, the Site allows you to submit your privacy choices to us. Please see below for information on submitting these choices and contacting us about privacy concerns or for questions about this privacy policy. We use consumer information collected from many sources other than the Site to provide marketing products and services, and you can find certain related legally required disclosures below.

The sections of the privacy policy below give important details that explain the summary above, and we encourage you to review the entire policy.

Information We Collect Through the Site

We collect several different categories of information when you use the Site, which includes personal information and other information about you and your organization, information about how you use the Site, and technical information about your devices and software.

Personal Information Collected Through the Site

Through the Site, you may request information from Wiland, including thought leadership content or Wiland news and updates. To enable this, Wiland will request that you submit personal information such as your name, phone number, postal address and email address. We may also collect other information such as your job title, your organization, the industry in which you work, and your content interests or preferences. We receive information from other sources, such as data partners, outside of the Site, which may include information about you or your organization and may be combined with information we collect through the Site in order to have a more complete view of Wiland’s clients and prospective clients. We collect your personal information through the Site in obvious ways through accurately-labeled forms and input fields.

In some instances, we may combine other types of information about you with personal information, such as inferring geographical location from your IP address and combining behavioral data about your usage of the Site with your name. If we combine other types of information about you with your personal information, we will treat the combined information as personal information.

We may also receive your personal information when it is submitted through our Career Center. This information may include your name, contact information, employment history and information about others such as personal references. You determine what information you may provide to us for these purposes. Through the job application process and our human resources function, we may also collect and associate other information that you or third parties provide to us with the information you submit through the Career Center. Please see the section below entitled “Wiland Career Center” for additional information on how Wiland treats personal information submitted through the career center.

You may also provide your personal information to us when exercising your privacy choices or submitting privacy complaints, as described below.

The Site does not knowingly collect, accept, or store sensitive information such as Social Security Numbers, driver’s license numbers or records, banking information, credit card numbers, criminal records, doctor or hospital records, or children’s information. We ask that you not submit this type of information through the Site, including the Wiland Career Center. Of course, we cannot control what information you choose to submit to us. If you submit such information we will use, share and secure it in accordance with this privacy policy.

The Site is meant for a general adult audience. We will not knowingly create, collect, or store information from persons younger than 18 years of age through the Site. If we learn that we have collected information about someone under the age of thirteen through the Site, we will delete that information as soon as practicable. It is a violation of the Site terms of use for persons under thirteen years of age to submit their personal information through the Site. Wiland does not knowingly sell the personal information of individuals under 18 years of age without affirmative authorization.

Other Information Collected Through the Site

We collect certain non-personally identifiable information about you through the Site in various ways. For example, we collect information to enable us to identify you online across the internet on a non-personally identifiable basis. This information may be collected through cookies, web beacons or other technology that is not combined with personal information. We do not combine your personal information collected through the Site with your online behavior from other websites. For additional information on these technologies, please see Cookies & Other Information Storage Technology, below.

We also collect information relating to your access to the Site and how you use it on a non-personally identifiable basis. For example, we collect information about how you use the Site such as the pages you visit, the time you spend on each page and with which content you interact as well as any search parameters you use. We also collect information about the hardware and software you use to interact with the Site such as your operating system, browser version, or whether you have certain browser add-ons enabled. This information may also include the device ID of your mobile device or your computer’s IP address, or the location data associated with those identifiers.

 

How We Use and Share Information Collected Through the Site

Personal Information Collected Through the Site

We may use, transfer and disclose personal information collected through the Site to support our business for the same purposes as we do other types of information we collect outside the Site. Please see, “How We Use and Share Personal Information for Our Internal Business Purposes,” below, for more information.

Other Information Collected Through the Site

We may use, transfer, and disclose types of information that we collect through the Site other than personal information for any purpose, except where applicable law requires otherwise. These uses may include, among other things:

  • helping us better understand your user experience while on the Site and helping us improve and develop the Site and Site content
  • facilitating advertising across the web for Wiland and for third parties
  • improving our products, services, marketing, and business processes

Cookies & Other Information Storage Technology

Wiland.com and third parties use cookies and similar information storage technologies like web beacons, HTML5 local storage and more in connection with the Site to share with one another non-personally identifiable versions of user information collected at this site. We may use that information to link to and issue non-personally identifiable cookies containing demographic or intent-based data for online behavioral advertising purposes. Such cookies do not contain personally identifiable information.

There are many tools you can use to limit the amount and type of device information websites collect. You could, for example, disable cookies in your browser or use an ad-blocking program. You are welcome to do so, and none of this will violate either this privacy policy or the Site terms of use. But disabling or circumventing certain features may affect your experience at the Site. Global Privacy Control and Other Privacy Choice Signals

We believe the current state of the industry and applicable law around how to respond to browser or device based privacy signals is unclear and evolving. We do not “sell” or “share” for targeted advertising the personal information collected via the Site, as these terms are defined under applicable privacy law. When we encounter a signal we have determined to be appropriate or feasible (e.g., “global privacy control” or a signal specified by a regulatory authority), we disable certain information collection for that browser or device.

Email and Wiland.com

We may send you surveys requesting your feedback regarding the Site or to contact you about our products and services. You should be aware that we may be required by law to contact you in certain circumstances. If you would like to opt-out of business-to-business email communications from Wiland, please use the link located at the bottom of the email you received. Some non-marketing communications are not subject to general opt-outs, such as communications related to product or service fulfillment or transactions and other support related information, Wiland events for which you have registered, disclosures to comply with legal requirements, and (where permitted by law) quality assurance surveys.

Third Party Tools & Services

You may share content on the Site using a number of social media services, such as Facebook, Twitter or LinkedIn. We offer these tools as a convenience to you and your social networks, and also because we hope you will share our content that you find useful with other parties. We cannot guarantee the security of these services. Your use of any such third party service is always subject to the terms and conditions of those parties and subject also to those parties’ privacy policies.

The Site may link to, include content from or integrate with websites or services from third parties. Examples of this might include social media sharing buttons on the Site (e.g. Facebook, LinkedIn or Twitter share buttons), links to informative articles hosted on other websites and other third party sites or services. These third parties may collect information about your visit to the Site. We are not responsible for the privacy practices of any of these third party sites or services. We encourage you to familiarize yourself with the privacy policies of these other services and websites if you have any concern about how they treat your personal information.

Personal Information We Collect Outside the Site

We may collect or receive personal information outside of the Site to operate, develop or improve our business and related processes and practices. This may include data we license or purchase from others, such as lists of individuals who represent businesses with which we do business or with which we may seek to establish a business relationship, or publicly available information such as data that companies, organizations or government entities make available to the public. It may also include data about individuals who provide services to our vendors or service providers, or individuals who contact our company about information and related information. We do not collect this type of information from individuals we know to be under the age of 18. How We Use and Share Personal Information For Our Internal Business Purposes

How We Use This Personal Information

We may use and share personal information we collect or generate for our internal business purposes (including via the Site) for any of the following purposes:

Our relationship with you

We will use your personal information to support your relationship with Wiland, such as to improve our business practices or the Site, to personalize your experience with us on and off the Site and to provide you technical support for the Site. We also use your personal information to notify you of service and product updates, new products, or events Wiland may be hosting or attending as well as to provide you other related information from Wiland. We may use your personal information to interact with you on third party social networks. Our interactions with you on a third party social network would be subject to that network’s privacy policies and terms of use.

Improve Products and Services

We may use your personal information to evaluate and improve our products, services, marketing, and business processes.

Privacy Choices and Concerns

We use personal information submitted through our Privacy Choices page or through our privacy complaint procedures only to give effect to the consumer privacy choices, to investigate and respond to concerns, to improve the Site and our products, services, marketing and business processes in light of the concerns, and as otherwise required by law.

Employment Inquiries

We use personal information submitted through our career center for our recruiting and employment related purposes. Please see the section of this policy titled “Wiland Career Center and other Human Resources Information” for additional details.

Legal Process

We will comply with applicable law and legal process even if it requires that we disclose personal information. However, we will seek to make all required disclosures in accordance with applicable law. If we consider it advisable, in order to ensure the safety or security of others or to avoid fraud or harm to our business or systems or those of our clients, vendors or partners, we may disclose your personal information to the extent necessary to mitigate the threat.

Corporate Transactions

If all or part of the company is sold, merged or otherwise transferred to another entity (including in connection with any bankruptcy or similar proceedings), or if a third party invests in our company, previously collected personal information may be transferred to the relevant third party as part of the due diligence process or at the closing of the transaction, as applicable.

How We Share This Personal Information

In some cases, we share personal information with our service providers, such as cloud services providers, marketing service providers, vendors and other third parties, to operate our business. We require that our service providers and these other third parties keep this personal information confidential. We require that they only use the personal information in furtherance of the specific purpose for which we disclosed it to them, and not in ways that constitute a “sale” or “sharing” for targeted advertising under applicable consumer privacy law, with the exception that we allow certain service providers to analyze information relative to vendor, partner or service provider payments with which they assist us for their own analytic or product development purposes (but they commit not to share any such information in individually identifiable form outside their organization for these purposes).

We retain personal information for our internal business purposes for varying lengths of time. In some cases, this information must be retained for specific periods of time for legal compliance or to administer our internal accounting processes, such as information relating to our clients or vendors. We retain information relating to individuals that are employed by or otherwise represent our clients or prospective clients indefinitely. Categories of Personal Information – California Legal Disclosure

California law requires that we disclose the categories of personal information that we have collected for internal business purposes in the last twelve months, as well as the category of sources for this information and parties with whom we have shared it for a business purpose in the last twelve months. We have collected the following categories of information in the last twelve months:

  • identifiers (e.g. name; alias; postal address; online identifiers; IP address; email address; account name; or similar identifiers)
  • categories of personal information described in Cal. Civ. Code § 1798.80(e) (e.g., telephone number – note that information included in this category may be duplicative of information identified in other categories)
  • characteristics of protected classifications under California or federal law (e.g., sex/gender; marital status; etc.)
  • commercial or transactions information (e.g., records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies)
  • internet or other electronic network activity information (e.g., information on a person’s interaction with a website, email, application, or advertisement)
  • professional or employment-related information (e.g., job title or current or past job history)
  • inferences about your predicted characteristics and preferences (e.g., inferences reflecting products or services you might consider or personal interests)
  • other information about you that is linked to personal information above (e.g., any personal information not specifically captured by the above categories)

We have collected the above categories of information in the last twelve months by generating it ourselves, collecting it directly from the individual, receiving it from our client or service provider (for example, an organization with which we do business that employs the individual), receiving it from business-to-business companies, or receiving it from information available on digital platforms. We share all these categories of information with our service providers, for our business purposes. As noted above, we do not “share” these categories of information for cross-context behavioral advertising and we do not typically “sell” these categories of information, with the exception that we allow certain service providers to analyze information relative to vendor, partner or service provider payments with which they assist us for their own analytic or product development purposes (but they commit not to share any such information in individually identifiable form outside their organization for these purposes) – the statutory categories of information provided to these service providers would be identifiers, categories of personal information described in Cal. Civ. Code § 1798.80(e), commercial or transactions information and professional or employment-related information, in each case related to the payments with which the service provider assists us.
General categories of personal information listed in California’s privacy law that we have not collected in the last twelve months for our internal business purposes include geolocation data, sensory information (e.g. audio, electronic, visual, thermal, olfactory or similar information) and education information (e.g. information that is not publicly available personal information, such as those records, files, documents, and other materials which contain information directly related to a student and are maintained by an educational agency or institution or by a person acting for such agency or institution).
In addition, California has defined certain types of information we may collect for operating our business as sensitive. These categories include certain government identifiers (the official category listed under California law is “social security, driver’s license, state identification card, or passport number”), and we sometimes collect government identifiers directly from an individual or the individual’s organization when necessary for billing, tax reporting or financial reporting purposes, or to meet other legal requirements. These categories also include account logins with access codes (the official category listed under California law is “account log-in, financial account, debit card, or credit card number together with security access code, password or credentials allowing account access”) – and we maintain account login information for individuals associated with certain of our clients or vendors using secure protocols in order to provide them access to our external-facing systems to exchange or access information relative to the products and services they order or that we receive. We only use this personal information for our internal business purposes and in manners that do not give rise to an “opt-out of processing” or “request to limit” under California law.
The categories of personal information defined as sensitive in California’s privacy law that we do not collect for our internal business purposes are biometric information used to uniquely identify a consumer, personal information collected and analyzed concerning a consumer’s health, personal information collected and analyzed concerning a consumer’s sex life or sexual orientation, precise geolocation data, racial or ethnic origin, religious or philosophical beliefs or union membership, contents of a consumer’s mail, email and text messages (other than as the intended recipient of the messages), and genetic data.

Wiland Career Center and other Human Resources Information

Through the Wiland Career Center, you can learn more about careers at Wiland. You can also submit your personal information for consideration for open positions by submitting your resume and cover letter. We do not request or require sensitive personal information such as information concerning race, ethnicity, religion, health, sexual orientation, or political affiliation in connection with our Career Center. If you provide this information to us through the Career Center, you authorize us to handle the information as specified in this privacy policy. For more information and certain legally required disclosures on how we more broadly collect, use and retain information relating to our current and former employees, their family members, dependents and beneficiaries and job applicants, whether on or off the Site, please see our Applicant and Employee Privacy notice.

Your provision of personal information to us for purposes of employment or application for employment (including in connection with our Career Center) is voluntary, and you determine the extent of information you provide to Wiland; please note that if you decide not to provide information, it may affect our ability to consider you for employment.

We may retain your information to consider you for other job opportunities. To the extent permitted or required by law, we may delete information at any time; accordingly, you should retain your own copy of any information you submit to us. You are responsible for the information you provide or make available to us, and you must ensure it is honest, truthful, accurate and not misleading in any way. You must ensure that the information provided does not contain material that is obscene, defamatory, or infringing on any rights of any third party; does not contain malicious code; and is not otherwise legally impermissible. Further, if you provide any information concerning any other person, such as individuals you provide as references, you are responsible for providing any notices and obtaining any consents necessary for us to collect and use that information as described in this policy.

Security

We use commercially reasonable administrative, technical, personnel, and physical measures to safeguard the security of all of the information we collect on or off the Site. All of our employees are made aware of and subject to our privacy requirements and our security protocols. We undergo an annual security audit in an effort to ensure that our systems are secure. We principally store your information on servers located in the United States, but certain of our service providers may store information for us worldwide.

Consumer Data We Collect and Use Outside the Site for Our Products and Services

We are a provider of marketing related products and services, which involves collection and use of consumer personal information to help U.S. consumers receive relevant marketing offers. This is not information we collect through the Site, but rather consumer information we receive through a number of other sources.
Please note, our marketing products and services are designed only for use in marketing to United States consumers 18 and older. We do not knowingly collect information about consumers in other locations or about children for our marketing products and services, and do not permit other parties to send it to us. We also don’t knowingly collect information historically considered to be highly sensitive in the United States such as credit card or bank account numbers, Social Security Numbers or other government-issued identifiers or HIPAA data or other information specifying a consumer’s medical conditions. We prohibit other parties from sending us this type of data relative to our marketing products and services.

Privacy Choices And Your California Privacy Rights

We give U.S. consumers several privacy choices, as described in our Privacy Choices page. Our Privacy Choices page contains information on how to submit each of these choices. It also includes information about how we comply with California’s “Shine the Light” law and other information about legally required notifications, including rights that residents of California (and potentially other states) have regarding how we use their personal data.

Policy Updates

This privacy policy and the Privacy Choices page are the primary means by which we notify you about our collection and use of your information for our internal business operations (including via the Site) and certain legally required disclosures regarding our collection and use of consumer personal information for our products and services and associated legal privacy choices consumers may have. The privacy policy is subject to future changes. Any future version of the Policy generally becomes effective at the time the Site posts it to the web, unless otherwise required by law. If we make material changes that affect how we use or share your information we will post a prominent notice in this section of this privacy policy notifying users when it is updated. By using, and continuing to use, the Site you agree to this Policy.
