Acceptance of Terms
The Site reserves the right to modify the Terms and Policies at any time and in any manner. The Terms and Policies always become effective at the time that the Site officially posts them to the web. So by continuing to use any service, function, or feature of the Site, you agree to be bound by the Terms and Policies then current.
In order to enjoy some of the functionality of the Site, you must first register at the Site. If you are a registered user of the Site and these Terms change, then you will be required to agree to the new Terms before you are allowed to log in and continue your use of the services.
The Site reserves the right to update or otherwise modify its services, content, functions, and features at any time. The Site may do so without notice to its users (the Community). Any change to the services, functions, or features of the Site, significant or otherwise, does not constitute a breach of the Terms and Policies and will not constitute a basis for liability to any user.
The content on the Site, irrespective of how that content is accessed or used by you and irrespective of the original source of the content, is intended for your personal, educational use and enjoyment. Site content may be downloaded for such purposes but may not be republished or made available for sale in any manner without our express written permission. Professors and other instructors are encouraged to use our content for educational purposes provided we are given appropriate acknowledgement.
The Site regularly updates its content and strives for accuracy and objectivity. Any failure by the Site to meet these standards, however, does not constitute a breach of the Terms or Policies and will not constitute a basis for liability to any user.
The content provided by the Site is protected by copyright law where applicable. It is not a violation of its copyright if you download or otherwise make a single copy of any copyrightable content provided that such copy is for your own personal, one-time, non-commercial use.
Any fair use of the Site’s content must include a notice that the work is protected by copyright and indicate that the copyright is held by Wiland, Inc..
User-generated content is any content created or copied by you or another member of the Community which is then published on the Site by any means.
By submitting content to the Site, you acknowledge that you have the right to, and you thereby do, grant the Site an irrevocable, unrestricted, transferrable, perpetual license to reproduce that content, to prepare derivative works from that content, to distribute that content by any means, to perform publicly any content which can be performed, to display that content publicly, and, in the case of sound recordings, to perform that content publicly by means of digital audio transmission. By submitting content you further agree to allow the Site to use the content in any service or feature of the Site and in any promotional material for the Site.
The Site does not guarantee the accuracy of any content. The Site reserves the right to delete user-generated content which does not comport with the Terms and Policies.
You agree not to submit, in any form, content that is pornographic, libelous, defamatory, abusive, obscene, discriminatory, or otherwise illegal or destructive to our purpose, which is to provide constructive content that is beneficial to the community. You agree not to spam, start flame wars, or otherwise antagonize any user or the Community. You agree not to violate or infringe the rights of another, and you agree not to plagiarize another.
You agree to make only non-commercial use of the Site.
Representations and Warranties
You represent, warrant, and covenant that (a) no content which you submit violates any of these Terms and Policies or any law, (b) you are at least thirteen years old, and (c) you are competent to agree to these Terms and Policies under any law governing your conduct.
You hereby indemnify, defend, and hold harmless the Site, anyone who holds a proprietary interest in the Site, anyone whose authority to act derives from the Site, and anyone who has the authority to control the site (collectively, the Indemnified Parties) from and against any and all liability and costs, including, without limitation, reasonable attorney’s fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of these Terms and Policies. You will cooperate as fully as reasonably required in the defense of any such claim. The Site reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.
The Site does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed, uploaded, posted, submitted, or otherwise distributed through the Site or any of its services. You acknowledge that any reliance on any such material is at your own risk.
The Site, its services, and all downloadable software are distributed on an “as is” basis without warranties of any kind, whether express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular use. You hereby acknowledge that the use of the Site services is at your sole risk. You further acknowledge that the descriptions on the Site of the products and services on offer from Wiland, Inc. constitute marketing material and do not give rise to any warranty of any kind, whether express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular use.
Registration and Security
When you register at the Site, you must provide your name, a valid email address, and a password or use a valid ID from a social media service that you have the right to access. Each set of login credentials are to be used by one individual. You should choose a strong password which contains upper and lower case letters, numerals, and special characters. You are responsible for your own password and its protection. We store only a hash of your password and have no way to retrieve or reproduce it.
When you log in to the Site, you must use your own registration credentials. You may not use the credentials of another user. You may not register with credentials that the Site deems offensive or otherwise objectionable.
After you register, you will have the opportunity to volunteer additional information about yourself. By volunteering this information you warrant that it is accurate, up to date, and correctly identifies you; the Site does not condone activity that may be fraudulent. If you believe that your credentials have been compromised, you should immediately inform the Site.
You must be thirteen years old or older to use any part of the Site.
Irrespective of the particular means by which the Site or its services are accessed or utilized, you are responsible for all usage of, and activity at, the Site under your credentials. Any breach of these Terms or Policies will result in the termination of your account and your privileges under these Terms and Policies.

Termination of User Accounts
The Site may, in its sole discretion, terminate or suspend your access to all or part of the Site or its services for any reason. You can permanently disable your account at any time from your account page.
Any software which the Site provides or otherwise makes available for use is intended solely for the benefit of site visitors and/or registered users. You are licensed only to use the software for its obvious intended purpose. You may not sublicense, assign, or transfer any license granted by the Site to another individual or organization.
You may not reverse-engineer, modify, or hack any software provided by the Site or its services. Software is, of course, protected by copyright. Your use of the Site’s software is therefore subject to applicable copyright law.
These Terms and Policies have been made and will be construed and enforced according to the laws of the State of Colorado. Any action filed to enforce these Terms or Policies will be brought in the federal or state courts located in the State of Colorado.
These Terms operate to the fullest extent of the law. If any provision herein is deemed unlawful, void, or unenforceable, that provision is deemed severable from these Terms and Policies and the remainder of the Terms shall continue in effect.
